摘要
发生在学校、教师、学生之间的教育纠纷,具有其特殊性,需要建立对应的纠纷解决机制.教育法典编纂提供了一个重要契机,可以对教育纠纷解决机制进行体系化重构.在排除普通行政纠纷和民事纠纷后,狭义的教育纠纷可以根据专业性、内部性等因素,分为"不可诉纠纷"和"可诉纠纷".针对不可诉纠纷,可设置"教育申诉—教育仲裁"的二阶段纠纷解决机制,针对可诉性纠纷,可以设置"教育申诉—行政复议—行政诉讼"的三阶段纠纷解决机制.教育纠纷解决机制在法典中的呈现,在内容上需要在总则和分则之间形成规范呼应,在表达上应该根据不同情形选择最佳的法条类型.
Abstract
Educational disputes occurring among schools,teachers and students have their particulari-ties and require the establishment of corresponding dispute resolution mechanisms.The compilation of the education code provides an important opportunity for the systematic reconstruction of the education dispute resolution mechanism.After excluding ordinary administrative disputes and civil disputes,narrowly-defined educational disputes can be divided into"non-justiciable disputes"and"justiciable disputes"according to factors such as professionalism and internality.For non-justiciable disputes,a two-stage dispute resolution mechanism of"education appeal-education arbitration"can be established.For justiciable disputes,a three-stage dispute resolution mechanism of"education appeal-administrative reconsideration-adminis-trative litigation"can be established.The presentation of the educational dispute resolution mechanism in the code requires,in terms of content,the formation of normative correspondence between the general pro-visions and the specific provisions,and in terms of expression,the selection of the best type of legal provi-sions according to different circumstances.
