摘要
我国的自动化行政裁量应用在政策推动下处于世界领先水平,但存在数据瑕疵、转译偏差、算法黑箱等基础诱因,易产生行政权利与义务被技术性悬置、官僚系统越权与卸责蔓延、机械裁量与个案正义相冲突等负外部效应.若要科学解决这些基础问题及其负外部效应,则需改进既有的发展优位规制模式,构建兼顾创新发展与合理规制的包容性规制框架.在以人为本与权利保障双向融合的技术赋权趋势下,自动化行政裁量的技术创新应注重提升公民参与行政活动的信息能力.技术性正当程序是正当程序的数字化升级与过程论阐释,有助于推动自动化行政裁量应用边界的划定与实质化人工干预机制的构建.
Abstract
The application of automated administrative discretion in China is at the forefront globally under the impetus of policies.However,there are fundamental factors such as data flaws,translation devia-tions,and algorithm black boxes,which are prone to negative externalities such as the technical suspension of administrative rights and obligations,the spread of bureaucratic overreach and shirking of responsibili-ties,and conflicts between mechanical discretion and case-by-case justice.To scientifically address these fundamental issues and their negative externalities,it is necessary to improve the existing development-pri-ority regulation model and establish an inclusive regulatory framework that balances innovative development and reasonable regulation.Under the trend of technological empowerment characterized by the two-way in-tegration of people-oriented principles and rights protection,technological innovation in automated adminis-trative discretion should focus on enchancing citizens'information capacity to participate in administrative activities.Technical due process is the digital upgrade and process-theoretical interpretation of due process,which is conducive to promoting the demarcation of the application boundary of automated adminis-trative discretion and the construction of a substantive manual intervention mechanism.
