摘要
由于规范不足和理解差异,社会治理检察建议在发挥良好社会治理效果的同时,也存在多发、滥发的问题.最高人民检察院发布的一系列经典案例很好地勾勒出社会治理检察建议在实践运作中的实际情况,包括制发对象、制发时机和制发情形三个维度.从历史梳理的角度来看,这一制度并非横空出世,而是经历了一般监督时期、社会治安综合治理时期、自我规范时期等漫长的发展过程.在性质上,社会治理检察建议应当定位于检察机关的法律监督职权,区别于一般监督,这是明确其适用边际的前提要件.为避免检察权的肆意扩张,应当在制发对象上进行适当限缩,以公共属性和行政属性为限,考量与案件的关联度.在制发时机上予以明确,以依托类案制发为主,减少针对个案制发检察建议,避免不依托案件的抽象监督.在建议类型和情形上进一步完善,探索更为周延的检察建议类型划分,并细化既有的制发情形.
Abstract
Due to the lack of regulations and differences in understanding,procuratorial suggestions on social governance not only play a positive role in social governance,but also encounter the problems of ex-cessive issuance and abuse.A series of classic cases released by the Supreme People's Procuratorate well outline the practical situation of procuratorial suggestion on social governance,including the issuance ob-ject,issuance timing,and issuance circumstances.From a historical perspective,this system did not e-merge out of thin air but has undergone a long process of development,including the periods of general su-pervision,comprehensive social security governance,and self-regulation.In terms of nature,procuratorial suggestions on social governance should be positioned within the procuratorial authority's legal supervision function,distinct from general supervision,which is a prerequisite for clarifying its applicable boundaries.To avoid the arbitrary expansion of procuratorial power,appropriate restrictions should be imposed on the issuance objects,limited to public and administrative attributes,considering the relevance to the case.The issuance timing should be clarified,primarily relying on a series of cases for issuance,reducing the issu-ance of procuratorial suggestions targeting individual cases,and avoiding abstract supervision not based on specific cases.Further improve the types and circumstances of suggestions,explore a more extensive classi-fication of the types of procuratorial suggestions,and refine the existing issuance circumstances.
