摘要
行政协议的实践适用无法回避公私法的调和问题,为规避行政权"遁入私法"的风险,应在规范视角下明确其适用标准.因适用标准的构造差异,源于"法律保留"的不同解释,可通过不同解释的要素化分解,在传统行政与行政协议的对应关系下,由行政形式选择理论作为转介,类比归纳为行政协议适用标准的考量要素,并围绕兼顾标的公共性与实践适配性,形成"内部要素考量为主,外部要素考量为辅"的考量体系.具体而言,围绕协议标的本身"公共性强度"的内部要素,可归结为替代或补充行政中的权利影响,以及转移行政中的公共性与效率协调.同时,对外部要素的辅助考量,主要围绕协议适用规范程度的判断展开,并归结为主体资格的规范程度、程序防弊机制的完备程度、行政协议救济的实现效果等考量要素.
Abstract
The practical application of administrative agreement cannot avoid the harmonization of public and private law.In order to avoid the risk of administrative power"escaping into private law",the application standards should be clarified from a normative perspective.Due to the differences in the structure of the application standards,the different interpretations of"legal reservation"can be decomposed through the elementalization of different interpretations,and under the correspondence between traditional administra-tion and administrative agreements,the administrative form selection theory is used as a referral,and the a-nalogy is summarized as the consideration factors of the application standards of administrative agreements,and a consideration system of"internal factors are mainly considered,supplemented by external factors"is formed around the publicness and practical adaptability of the subject matter.Specifically,the internal ele-ments surrounding the"public intensity"of the subject matter of the agreement itself can be boiled down to the impact on rights in alternative administration or supplementary administration,and the coordination be-tween publicness and efficiency in the transfer administration.At the same time,the auxiliary consideration of external factors mainly revolves around the judgment of the degree of application of the agreement,and is summarized into the degree of standardization of the subject's qualifications,the completeness of the proce-dural fraud prevention mechanism,and the realization effect of the administrative agreement remedy.
