摘要
宪法价值是行政法价值的基础,宪法要求行政法成为价值统一体,行政法典正是这种价值统一体的鲜明体现.行政法典具有四方面强大的宪法功能,即授权功能、控权功能、保障公民权利功能以及实现国家富强功能.行政法典的宪法依据为行政法典提供宪法正当性,要求行政法典具备直接性、全面性和体系性.据此,建议尽快编纂行政法典,并将行政基本法典作为行政法典的理想形态.
Abstract
Constitutional value is the basis of the value of administrative law,the constitution requires administrative law to become a unity of value,and the administrative code is this unity of value.The admin-istrative code has four powerful constitutional functions,which can grant administrative power,control ad-ministrative power,protect civil rights and achieve national prosperity and strength.The constitutional basis of the administrative code provides constitutional legitimacy for the administrative code,which requires the administrative code to be direct,comprehensive and systematic.Therefore,it is suggested that the adminis-trative code should be compiled as soon as possible,and the administrative basic code should be regarded as the ideal form of administrative code.
