生成式人工智能(Generative Artificial Intelligence,GAI)是指能够自主地创造出新的内容或数据的人工智能系统,例如文本、图像、音乐、代码等.GAI在各个领域都有广泛的应用和潜力,但同时也带来了一系列的风险和挑战,例如版权、责任、隐私、安全、歧视等数据风险、内容风险、社会风险和法律风险,这四类风险所带来的主要法律挑战包括数据保护、内容监管、责任归属等.为了有效地应对和管理这些风险,可以构建一种基于类型化方法的GAI风险治理框架,旨在通过对GAI风险的分类、评估和控制,提出类型化的解决方案和建议,从立法、执法、司法和自律四种法律治理类型提出相应的措施和方案,如完善相关法律法规、建立监管机制和标准体系、加大执法力度、提高司法适应性和创造性、推动行业自律和社会共治等,以促进GAI的健康发展.
Abstract
Generative Artificial Intelligence(GAI)refers to an artificial intelligence system that can independently create new content or data,such as text,images,music,code,etc.GAI has a wide range of applications and po-tential in various fields,but it also brings a series of risks and challenges,such as copyright,liability,privacy,se-curity,discrimination and other data risks,content risks,social risks and legal risks.The main legal challenges brought by these four types of risks include data protection,content supervision,liability attribution,etc.In order to effectively deal with and manage these risks,a GAI risk governance framework based on a typed approach is pro-posed,aiming to propose typed solutions and suggestions through the classification,assessment and control of GAI risks,and corresponding measures and programs are proposed from four types of legal governance:legislation,law enforcement,justice and self-discipline:such as improving relevant laws and regulations,establishing regulatory mechanisms and standard systems,strengthening law enforcement efforts,improving judicial adaptability and crea-tivity,and promoting industry self-discipline and social co-governance,in order to promote the healthy develop-ment of GAI.
