摘要
正义是人类的永恒追求,是一个社会制度的首要价值.分配正义作为正义的一种类型,包含着财富分配正义和风险分配正义.财富因稀缺而产生了分配问题,风险则由于潜在的危险而产生了分配问题.风险分配正义关涉着风险分配过程和风险分配制度的正义,遵循着自由平等原则、互惠原则及差别原则.中国式现代化的"并联式"特征使得财富分配和风险分配被置于同一时空中,历时性问题共时性呈现.因此,实现风险分配正义,必须发展新质生产力,厚植风险分配的物质基础;变革不合理的风险分配秩序,确立合理的风险分配规范;建立健全风险防控机制,促进风险治理现代化.
Abstract
Justice,an enduring aspiration of humanity and the paramount value within any societal construct,en-compasses distributive justice,particularly in the realms of wealth and risk allocation.The scarcity of wealth neces-sitates its distribution,while the prevalence of potential hazards underscores the significance of equitable risk allo-cation.The pursuit of distributive justice in risk allocation focuses on the justice of the processes and institutional frameworks governing such distribution,adhering to principles of freedom and equality,mutual benefit,and differ-ential treatment.China's distinctive"parallel"path to modernization juxtaposes wealth and risk distribution within a condensed temporal and spatial framework,transforming historical sequential issues into contemporary,concurrent challenges.To address these,it is imperative to foster the development of novel productive forces,enrich the mate-rial foundation for equitable risk distribution;reform existing unjust risk allocation orders,establish normative frameworks that ensure fairness and equity;and strengthen risk prevention and control mechanisms,facilitate the modernization of risk governance to realize justice in risk allocation.
