A Historical Examination of Legal System Construction in Shaanxi-Gansu-Ningxia Border Region during the Yan'an Period and Its Implications
Creative transformation and creative development of the fine traditional Chinese culture and revolutionary culture,and in-depth distillation of the red rule of law genes of the revolutionary base area period and their inherit-ance and promotion are the key to the Chinese path to the modernization of the rule of law.During the Yan'an pe-riod,CPC leaders and the older generation of jurists in the border areas explored the establishment of a new type of rule of law civilization in line with China's national conditions.On the basis of critically inheriting the experience of the rule of law in the period of the democratic regime of peasants and workers,and from the perspective of sol-ving practical problems,they unified the consolidation of the revolutionary power and the governance of the base ar-eas into a rule of law track,and constructed a system of laws and ordinances,with the core of the constitutional documents,in order to explore the establishment of a democratic rule of law satisfactory to the people,both theoret-ically and in practice.They have explored the establishment of a democratic government under the rule of law to the satisfaction of the people,innovated and practiced non-litigation dispute resolution,and endeavored to provide peo-ple with efficient and convenient judicial resources,thus creating a stable,united,harmonious and orderly social situation in the Shaanxi-Gansu-Ningxia Border Areas.A systematic summary of the experience of building the rule of law in the Shaanxi-Gansu-Ningxia Border Areas during the Yan'an period provides many useful references and mirrors for the exploration of the Chinese path to the modernization of the rule of law.
