认罪认罚案件中侦查中心的表征、是非与应对

摘要
认罪认罚从宽制度侦查、起诉、审判各个阶段皆可适用,解剖其适用实质,是侦查奠定了认罪认罚的主基调,形成了以侦查为主,检法辅助的运行模式,是较为明显的以侦查为中心.在整个过程中,围绕的核心还是侦查,核心的外围,是对侦查的细化、补充、完善,并未真正动摇侦查的中心地位,并没有形成检察中心或者审判中心.于此,认罪认罚与侦查中心交集的提升效率、庭前预断、要件审查、二审信任可以保留,但对实体和程序错误需要警惕.应当确保侦查机关对案件取证、定性的准确性,强化公安司法机关对疑点和争点的实质审查,将明知性、明智性、自愿性分列保障,保障被追诉人反悔后的对抗能力,以维持实体和程序的底线公正.
Abstract
The leniency system for the cases of admitting guilt and accepting punishment can be ap-plied in every stage of investigation,prosecution and trial,analyzing its basic application is the keynote of investigation for the cases of admitting guilt and accepting punishment,and the operational model with the investigation as the core and the prosecution and trial as the supplement is a fairly clear mani-festation of the investigative center.In the whole process,the core is still the investigation,and the periphery of the core is the refinement,supplement and perfection of the investigation,which has not really shaken the core position of the investigation,and has not formed a prosecution center or a trial center.In this regard,the improvement efficiency,pre-court judgment,component review and trust in the second instance arising from the intersection of admitting guilt and accepting punishment cases and the investigative center can be retained,but the entity and procedural errors require vigilance.It is necessary to ensure the accuracy of the investigative organs in collecting evidence and qualitative a-nalysis of cases,strengthen the substantive examination of doubts and disputes by the judicial organs of public security,and ensure the intelligibility,wisdom,and voluntary protection respectively so as to ensure the confrontation ability of the accused person after reneging and to maintain the bottom-line justice of the entity and procedures.
