On the Obligations of Internet Platforms to Assist with Telecom and Network Fraud Prevention and Law Enforcementt
The source prevention and comprehensive governance of telecom and online fraud cannot be separated from the online control provided by internet platforms as the"first line of defense".The Anti Telecom Network Fraud Law provides provisions for internet platforms to provide technical support and assist law enforcement agencies and regulatory authorities,but there are still significant legal gaps in the specific content and procedural rules for technical support and assistance,which urgently need to be refined and improved.In this regard,it is necessary to thoroughly sort out the procedural law origins and governance law foundations of the obligation to assist with anti telecom network fraud and to explore the basic content of the obligations by drawing on the rich practical experience of platforms in assisting law enforcement.This includes understanding the attributes of initial computation,screening computation,and circular computation in platform assistance,distinguishing the two types of responsive assistance and proactive assistance,and proposing specific assistance rules such as proportional evidence obtainment,emergency assistance,cross-border evidence obtainment,online evidence obtainment,tiered responsibility,algorithm filing,real-time monitoring,emergency payment suspension,and situation feedback.These measures can be of use to better enhance the role of internet platforms of digital gatekeepers.
