Prosecutorial Power in Administrative Public Interest Litigation:Power Dilemma,Ideological Adjustment,and Correctional Path
In the process of handling administrative public interest litigation cases,prosecutorial power faces many issues such as guidance concepts deviation,unstable and unsustainable motivation for case handling,limited capacities,and ineffective public interest protection. In the process of deepening reforms and optimi-zing functions,the primary goal in conceptual terms should be to achieve effective public interest protection as the core of institutional design. This includes moving from formal rationality in of simply pursuing case num-ber to substantive rationality that pays more attention to supervisory effectiveness,balancing the restraint and initiative of prosecutorial power within the administrative public interest litigation system,and carrying for-ward the governance concept of co-governance and shared governance.Correspondingly,improving prosecu-torial power has a triple way:strengthening its own capabilities by improving specific prosecution supervisory powers,constructing a communication mechanism when facing the administrative organs to ensure the legal,flexible,and efficient safeguarding of public interest,leveraging third-party forces to enhance supervision,in-cluding communication and information sharing with entities such as the Supervisory Committee,people's congresses,news media,the general public,etc.
