Realistic Predicament and Completion Approach of the Notification and Commitment System Of Environmental Impact Assessment
In recent years,the pilot reform of the EI A notification and commitment system is in full swing nationwide.The main content of the reform of the EIA notification and commitment system is to replace the ex ante substantive examination with self-com-mitment by market players and to replace the ex ante regulation with ex post supervision.Although this institutional arrangement has played a positive role in enhancing the efficiency of approval and stimulating the vitality of market players,there are still some problems in the actual application process,mainly including weak legitimacy of reform initiatives,deviation from the risk-prevention function of the EIA system,lack of mature ex post regulatory tools,lack of effective institutional arrangements for public participation.Therefore,in order to promote the improvement of the EIA notification and commitment system,the reform should adhere to legal compliance and should emphasize risk prevention,at the same time efforts should be made to enhance the effectiveness of ex post facto supervision,im-provement of information disclosure and public participation mechanisms.
