Rule of Law Optimization Path for the Recycling and Utilization of New Energy Vehicle Batteries Under the Dual Carbon Goals
To achieve the dual carbon goals(carbon peaking and carbon neutrality goals),China has vigorously developed the new energy vehicle industry,but the related management of power battery recycling is still in the exploratory stage.The implementation of the extended producer responsibility system is still pending,current legislation provides insufficient guidance for public participation,and the government's regulatory framework is still imperfect.Considering the unique characteristics of power batteries,this paper aims to explore the theoretical foundations for their recycling and utilization management.Based on this,it is necessary and feasible to improve the legal system for the recycling and utilization of new energy vehicle power batteries in China.With reference to the experience and inspiration of the United States and Japan,an optimization path is proposed to clarify the legal responsibilities and obligations of market entities such as producers,sellers,consumers,and third-party enterprises,in order to implement the extended producer responsibility system.This paper also introduces economic incentives like taxes,subsidies,and environmental deposits to ensure effective market regulation.At the same time,the government supervision system should be improved by clarifying the supervision responsibility,strengthening access management,and strengthening the public participation system to address market failures and foster new approaches to the development of a circular economy.
