健康医疗数据治理体系建构的困境及对策

摘要
健康医疗数据是一种具有高商业价值和强人身属性的宝贵资源,开发与利用健康医疗数据带来了可观的数据红利,同时也导致数据泄漏风险显著提升.为了更好地利用数据造福社会,各国都致力于健康医疗数据治理体系的建构.然而,数据权利主体不明、对数据处理者监管不严与数据要素流通受阻这 3 大关键问题阻碍了健康医疗数据治理体系的建构.虽然健康医疗数据基本源于个人,但不宜将数据归属于个人所有,并进行绝对化与排他性的权利保障.健康医疗数据治理体系的建构应兼顾公共利益与个人权益,以多学科人员参与的全程监管系统为基础,以促进数据安全有序共享为目标,增强健康医疗数据处理的透明度,打破数据共享壁垒,推动我国医疗卫生事业的创新和进步.
Abstract
"Health care related"and"human related"are the two most essential characteristics of health data.Health data is a valuable resource with high commercial value and significant personal implications.The development and utilization of health data have yielded substantial data dividends but have also raised the risk of data breaches.All countries are committed to improve the health data governance framework to safely handle health data for the benefit of society.Countries worldwide are dedicated to enhan-cing the governance framework of health data to ensure its secure and beneficial utilization for society.However,three key challen-ges hinder the advancement of the health data governance system in China:unclear data rights ownership,inadequate regulatory o-versight,and restricted data circulation.Although health data primarily originates from individuals,attributing exclusive ownership rights to individuals is not appropriate.The health data governance framework should strike a balance between safeguarding public interests and protecting individual rights.It should be founded on a comprehensive regulatory system involving diverse experts and should aim to facilitate secure and organized health data sharing.This approach fosters transparency in data processing,enhances public trust in data utilization by the government,dismantles barriers to data sharing,and facilitates medical innovation and pro-gress.
