摘要
医疗卫生机构信息公开是我国卫生法治实践中的重要问题.目前来看,医疗卫生机构信息公开主要存在定位不清晰、公开范围不明确、保障措施不足等法律问题,亟需加以法治化建构.《医疗卫生机构信息公开管理办法》对信息公开做出了规定,在宏观价值层面,应当以依法公开原则、以人民群众为中心原则、积极稳妥公开原则和尊重专业判断原则为基础制定医疗卫生机构信息公开的优化对策.具体而言,应当明确医疗卫生机构信息公开的定位,以正面列举和负面排除模式界定医疗卫生机构信息公开范围,完善信息公开的保障措施.
Abstract
The disclosure of information in medical and health institutions is an important issue in the management practice of China's health industry.At present,there are some problems in the information disclosure of medical and health institutions,such as unclear system orientation,unclear scope of disclosure,insufficient safeguard measures,etc.,which need to be constructed by rule of law urgently.The"Management Measures for Information Disclosure of Medical and Health Institutions"have made relative-ly regulations on information disclosure.At the macro value level,the rule of law path of information disclosure in medical and health institutions should be constructed on the basis of the principles of openness according to law,convenience for the people,positive and stable openness and respect for professional judgment.Specifically,we should define the system orientation of medical and health institutions'information disclosure,define the scope of information disclosure in Medical and Health Institutions with positive enumeration and negative exclusion models,and improve the safeguards for information disclosure.
