Legal Enforcement of Morals and Potential Limits of Surrogacy Regulation
Based on the non-commercial gestational-surrogacy as a benchmark evaluation model and the basic characteristics of social cooperation,the legitimacy of surrogacy can be justified.Opponents of non-commercial surrogacy are suspected of intentionally exaggerating the risks of harm and the ethical risks.Even so,the ways in which reproductive capacity is used is closely related to the relationships and plans that people value,so they should be given legal attention and response.Commercial surrogacy,because of its commercial attribute,is more likely to force individuals to make choices on this issue and attempt to change people's lifestyles,which may bring additional risks.Non-commercial gestational-surrogacy without commercial factors should be allowed because of its prudent and refined handling.The attitude of law to surrogacy does not necessarily have to be an"all or nothing"relationship,and a more reasonable approach is to formally allow it with strict limitations in content.
