On the Legal Concept of Health and Medical Treatment Data
Due to the universal applicability and high abstraction of legal norms,the concepts of data across various professional fields are often difficult to define precisely.To overcome the dual dilemma currently faced by the legal concept of health and medical treatment data,namely the inconsistency in the naming and connotations of normative terms,and the insufficient supply of academic research,it is essential to clarify the distinction between data and information in order to define the concept of data.Furthermore,by distinguishing between health and medical treatment data and general health data,the concept of health and medical treatment data can be established.Based on two key dimensions,the source of data and the connection to the data subject,health and medical treatment data is defined as information generated during the provision of medical services,recorded electronically,related to an identified or identifiable data subject,and capable of directly or indirectly revealing their physical and mental health status.
