On the Legal Regulation of Internet Medical Services
Internet medical services have unique functional positioning and vast application prospects.However,under current regulations,Internet medical practices in China face legal challenges.China should follow the"triangle rule",clearly authorizing the flexible adjustment to the rules of Internet medical services for special periods and special regions at the legislative level,and allowing targeted adjustment of the following rules.First,adjust the rules for follow-up visits to allow initial consultations to be conducted online,but require real-time synchronous communication between doctors and patients and timely follow-up by doctors.Second,adjust the rules for common and chronic diseases using a"negative list"approach,explicitly listing and minimizing the scope of diseases that cannot be diagnosed and treated online.Third,set the duty of care benchmark based on the average level of diagnosis and treatment in the internet context to create reasonable space for online diagnosis and treatment by doctors.
