我国网络直播平台监管存在的问题及行政法规制研究

摘要
近年来,随着社交媒体的飞速发展,"宅经济"和"云生活""云办公"等网络直播平台纷纷涌现,对社会带来了巨大影响与改变.与此同时,网络直播平台作为网络直播的载体及第三责任方,规范其成长、监督其发展的过程中必然会遇到各种挑战.通过分析目前监管情况和中国的互联网直播行业的发展趋势,并探讨其中的监管挑战.目前的监管缺乏明确的角色定位,缺乏完善的法规制度,以及过时的监管措施.为此,我们建议:首先,要加强对网络直播平台的日常监控,其次,要组织起一个覆盖全国的网络直播平台协会,以及实施有效的行政法规,以保障其有效运营.
Abstract
In recent years,with the rapid development of social media,online live streaming platforms such as"Homestay Economy","Cloud Life",and"Cloud Office"emerged one after another,bringing tremendous impact and change to society.At the same time,as the carrier and third party responsible for online live streaming,online live streaming platforms inevitably encounter various challenges in regulating their growth and development.This article is on the current development trends of China's internet live streaming industry and the regulatory challenges involved.The author believes that the current regulation lacks a clear role positioning,a sound regulatory system,and updated regulatory measures.The paper suggest that we should strengthen the daily monitoring of online live streaming platforms,organize a nationwide online live streaming platform association and implement effective administrative regulations to ensure its effective operation.
