Abusive data dominance behaviour in the digital economy era not only induces competition damages such as direct exclusion effect,supply squeeze effect and market blocking effect,but also hinders the flow and use of innovative elements,which is not conducive to the full release of the value of data elements.China's Anti-Monopoly Law and Anti-Unfair Competition Law have both been digitally transformed around emerging industries,but how to coordinate the relationship between the two in order to shape the systematic rules of data competition is still inconclusive.In China,it is appropriate to regulate the abuse of data dominance with a hierarchical structure of market dominance and relative trading advantage,while the Anti-Monopoly Law adjusts the exclusive abuse and focuses on guaranteeing the accessibility of specific data,and the Anti-Unfair Competition Law adjusts the exploitative abuse and focuses on safeguarding the right to fair trade.
