In the age of artificial intelligence,the reform of China's criminal justice system faces the dual missions of ensuring compliance with judicial laws and application of technology.We need to strengthen the supervision of prosecution over investigation,and balance the relationship between the use of big data technology and the protection of civil rights.Adhere to the equality of prosecution and defense,and achieve a balance of rights in data access by establishing a public technology service platform;and in the field of trial,we should adhere to trial-centralism,judge neutrality,and decision-making core status to ensure the correct application of artificial intelligence technology assistance,while paying attention to the transparency and interpretability of algorithms,respecting the defendant's right to choose,and reasonably limiting the application scope of artificial intelligence assistance systems in cases.
