The copyright technical protection measures system is directly embedded in traditional copyright law,but faces systemic controversies such as providing legal protection over copyright,eroding consumers'rights,and raising the risks of modernity.From the legal demand of maximizing copyright protection benefits and precision in risk governance,it is necessary to integrate three kinds of norms on copyright technical protection measures:prohibition,exception and obligation.In recent years,through the revision of the Copyright Law,China has sorted out the scattered regulations on the copyright technical protection measures,but still has not fundamentally solved the related systemic issues.To strengthen the systematic construction of the copyright technical protection measures system,further amendments to prohibitive norms should be made,clearly prohibiting only the provision of circumvention means,services,or devices to others.At the same time,we should construct a moderately open exception system and design legal mechanisms for circumvention assistance,so as to resolve disputes over imbalances in related copyright interests.Furthermore,copyright law should clearly define the users'obligations of information disclosure and prohibition of misuse of technical protection measures,supplemented by professional regulation to achieve reasonable risk prevention and control.
