The concept of"judicial access"is rooted in the modern rule of law system and is centered on maximizing the protection of citizens'legitimate rights and interests through the judicial process.Traditionally,judicial access has faced multiple challenges,such as the high cost of legal services,poor judicial operation and weak public awareness of the rule of law.With the deepening of the digital transformation of the judiciary,these traditional challenges are gradually being mitigated.Digital means have effectively reduced the cost of litigation,improved the efficiency of case handling,and enhanced citizens'awareness of the rule of law,responding to a certain extent to citizens'demand for judicial access.From a comparative legal perspective,China has made remarkable achievements in the digital construction of the judicial system.However,judicial access in the digital era also faces two major challenges:the digital divide and excessive litigation.The digital divide is reflected in the differences in access and use by different groups,affecting fairness and resource allocation.Excessive litigation is driven by industry interests,crowding out limited judicial resources.In response to this series of challenges,China should strive to bridge the digital divide,utilize technology to identify malicious lawsuits,and establish a regulatory system for digital technology to ensure that digital technology can better serve the goal of judicial access.
