论乡村振兴的人权治理

在乡村振兴人权治理的二元主体中,国家治理体现为人权思维的落实,农民治理主体则表现为人权追求的实现。以人权为元价值机理整合,在乡村振兴人权治理中构建起了彼此承认的主体间性。乡村振兴人权治理的交往系统,既是交往制度得以顺利开展的理论根基,也是交往机理的外在制度建构。借由交往机理与交往制度的有效运转,在交往商谈中尊重和保障人权的交往理性得以获得各方认同,并借助法律建制化的方式搭建起稳定的人权规范体系,进而为人权治理的开展提供稳定的规范保障。乡村振兴人权治理的合作面向是国家与农民两大治理主体最终形成的合作关系,并在乡村振兴人权治理中确保多元主体的生存权、发展权、政治权利与幸福生活权等得到切实保障。
On Human Rights Governance for Rural Revitalization
In the dual subject of human rights governance for rural revitalization,national governance is embodied in the implementation of human rights thinking,and the subject of farmers'governance is embodied in the realization of human rights pursuit.At the same time,the integration of human rights as a meta-value mechanism constructs inter-subjectivity of mutual recognition in human rights governance for rural revitalization.The interaction system of human rights governance for rural revitalization is both the theoretical foundation of the interaction system to be successfully carried out and the external institutional construction of the interaction mechanism.Through the effective operation of the interaction mechanism and the interaction system,the interaction rationality of respecting and protecting human rights in the interaction and negotiation can be recognized by all parties,and a stable human rights normative system is built up by means of legal establishment,thus providing stable normative guarantee for the development of human rights governance.The co-operation of human rights governance for rural revitalization is a cooperative relationship between the state and which ensures that the rights to life,development,political rights and well-being of multiple subjects are guaranteed in the governance of human rights for rural revitalization.
