汉口是长江流域的重要港口,其近代商业活动极其活跃,经济发达,商事纠纷种类十分丰富.在这种社会背景下,汉口商会以其特殊的商业地位逐渐成为汉口地区解决商事纠纷的中坚力量.近代汉口商会在商事纠纷化解过程中的理案记录,从调处主体、调处依据、纠纷类型和调处程序等多个层面积累了诸多的实践智慧,可为我国现代商事调解的发展提供蓝本,推动商事调解走向调解主体专业化、受案范围特殊化和解纷服务市场化的道路.
Abstract
Hankou is an important port on the Yangtze River,with extremely active commercial activities,a developed economy,and a wide range of commercial disputes.In this social context,Hankou Chamber of Commerce,with its special commercial status,gradually became the backbone of resolving commercial disputes in Hankou area.In the process of resolving commercial disputes,modern Hankou Chamber of Commerce accumulated a lot of practical wisdom in various aspects such as case records,mediation entities,mediation basis,dispute types,and mediation procedures.This can provide a blueprint for the development of modern commercial mediation in China and promote the path towards professionalization of mediation entities,specialization of case acceptance scope,and marketization of dispute resolution services.
