论环境保护地役权构造中的"需役地"

摘要
环境保护地役权的需役地"虚化",导致供役地拼接临近意义上的需役地块实体范畴消失,却可在行政划定的"自然保护地"辖区整体范畴上,以环境生态保护整体价值的形式重聚,由此形成对自然保护地辖区范围内各地块与资源要素(供役地)财产权利中的生产经营与生活价值的制衡手段,从而与传统民法中地役权构造形成基础性技术通约.这有利于形成适应保护地核心保护区向一般控制区保护目的渐变调整,以及相应保护方法中私法与公法保护手段衔接协同与配比变化的方案.
Abstract
The"virtualization"of the easement for environmental protection leads to the disappear-ance of the physical scope of the dominant tenement parcel in the sense of its proximity to the splicing of the servient tenement,but it can be regrouped in the form of the overall value of environmental and ecological protection in the overall scope of administratively demarcated"nature conservation land"jurisdiction,thus forming a fundamental check and balance on the property rights of the parcels and resource elements(servient tenement)within the scope of traditional civil law easement construction.In this way,it can form a means of checking and balancing the production and living value of the property rights of the land and re-source elements within the jurisdiction of the nature reserve,thus forming a basic technical agreement with the construction of easement rights in traditional civil law.This is conducive to the formation of the gradual adjustment of the conservation purposes from the core area to the extended area of the reserve,as well as the presentation of the synergistic and proportional changes in the interface between the private law and the public law means of protection in the corresponding conservation methods.
