摘要
耕地保护补偿制度包括耕地保护补偿和耕地保护激励.目前耕地保护补偿制度相关政策存在缺少农业活动考量、激励对象错置、给付资金滥用、农业振兴目标实现困难等问题.耕地保护补偿和激励作为公法上补偿和激励的缩影,在主体、范围、内容方面存在差异.以奖代补因主体界定标准不完善、范围界定裁量化、给付请求权保护弱化会引起新的政策风险.耕地保护补偿制度应当以补偿为主、激励为辅,遵守依法行政、公平正义、诚实信用原则,以耕作者为主体,以农业活动为范围界定标准,在内容上强化可得利益的保障.
Abstract
