摘要

低效用地再开发有助于缓解土地供需矛盾,是实现土地节约集约利用的题中之义.通过分析中央及地方政府的规范性文件,可以发现低效用地的内涵不清,再开发模式呈现多样性特征.利益主体共享低效用地再开发增值收益有必要性、规范性和实践性.增值收益共享的核心是厘清各利益主体的权利、义务或职责.政府有调研、编制规划和审批、健全配套措施,完善监管制度,保障公共利益的职责;再开发者有分享土地增值收益的权利,承担缴纳保证金、出资以及不擅自变更再开发项目的义务;原权利人有知情权、参与权和监督权以及申请有偿收回低效用地的权利和依规申请专项资金用于专项建设的权利等特色性权利.

Abstract

Redeveloping inefficient land is the essence of achieving land-saving and intensive use which helps to alleviate the contradiction between land supply and demand.By analyzing the normative doc-uments of the central and local governments,we can find that the connotation of inefficient land has not yet been unified and its redevelopment patterns presents diversity.It is necessary,the basis and the corre-sponding practice for stakeholders to share the value-added benefits of inefficient land redevelopment.The core of benefit sharing is to clarify the rights and obligations of stakeholders.Government has the responsi-bilities of conducting research,formulating plans and approving,completing supporting policies,building a sound regulatory system,and safeguarding public interests;re-developers have the right to share land value-added benefits and bear the obligation of paying deposits,fulfilling capital contributions,and not changing redevelopment projects without authorization;original rights holders have the right to be in-formed,participate and supervise,and to apply for paid recovery of inefficient land,to apply for special funds for special construction to regulations and other characteristic rights.
