论农地流转合同的效力困境

摘要
农地流转合同是推动农地有序流转的关键交易工具,发挥着"毛细管作用",对农地流转的规模和效益具有重要意义.同时,农地流转合同受到国家对农地进行管制的约束,而相关法律规范是否为效力性强制性规定则难以区分和辨识,因此一旦农地流转合同违反强制性规定,合同效力判断即成为难题.通过对可能影响农地流转合同效力的法律规范的梳理,发现对农地流转进行管制的法律规范存在数量过多、对合同效力的影响难以确定的情况,这些构成了农地流转的障碍.农地流转合同效力困境的深层原因在于农地保护与自由流转、农地保障性功能和财产性功能这两组价值冲突,需要通过完善合同管理制度和司法裁判路径予以纾解,未来应进一步通过深化农地权利改革以减少管制,同时通过增强法律规范的明确性予以彻底解决.
Abstract
The contract for the transfer of agricultural land is a key transaction tool for promoting the orderly transfer of agricultural land,playing the role of a capillary tube,and is of great significance to the scale and efficiency of the transfer of agricultural land.At the same time,the contract of agricultural land transfer is subject to the constraints of state control of agricultural land,and it is difficult to distinguish and identify whether the relevant legal norms are mandatory provisions of validity,therefore,once the contract of agricultural land transfer violates the mandatory provisions,the judgement of the validity of the contract becomes a difficult problem.By sorting out the legal norms that may affect the validity of the contract of ag-ricultural land transfer,it is found that there are too many legal norms regulating the transfer of agricultural land,and it is difficult to determine the impact on the validity of the contract,which constitutes an obsta-cle to the transfer of agricultural land.The deep-seated cause of the dilemma of the effectiveness of agricul-tural land transfer contracts lies in the conflict of values between the protection of agricultural land and its free transfer,and between the safeguarding and property functions of agricultural land,which needs to be resolved through the improvement of the contract management system and the path of judicial adjudication,and which should be further resolved in the future by deepening the reform of the right to agricultural land,reducing the regulation,and enhancing the clarity of the legal norms.
