摘要
未登记房屋继承纠纷是司法审判的难点.对435个未登记房屋继承纠纷案例整理分析发现:就未登记房屋的继承请求,法院既有裁决不作处理的,也有裁决处理房屋的管理使用权或处理房屋所有权的;对拟继承的未登记房屋折价补偿款无法协商一致时的处理,也存在司法分歧.裁决不作处理,无法实现司法定分止争的审判效果,应当严格限制或规范其适用;裁决处理管理使用权尚缺乏法律援引,应当补充司法解释作为正式依据;裁决处理管理使用权或处理所有权,各有合理适用空间,应当基于司法实践归纳各自具体适用情形,缓和两者的适用冲突.当事人对未登记房屋的折价补偿款无法协商一致,不是裁决不作处理的充分理由;折价补偿的对象是管理使用权还是所有权,取决于法院对未登记房屋继承纠纷的处理方式.
Abstract
Unregistered housing inheritance disputes are difficult to resolve in judicial trials.After or-ganizing and analyzing 435 cases of unregistered housing inheritance disputes,it was found that for inherit-ance requests of unregistered houses,the court has not only ruled not to handle them,but also ruled to handle management and use rights or ownership;there are also judicial differences on the handling of the unregistered house discount compensation to be inherited when there is no consensus.If the ruling is not handled,it cannot achieve the effect of judicial division and dispute resolution,and its application should be strictly restricted or regulated;there is still a lack of legal citation for the management and use rights of the ruling,and judicial interpretations should be supplemented as a formal basis;there is a reasonable ap-plication space for the management and use rights or the ownership of the ruling,and the specific applica-tion situations should be summarized based on judicial practice to coordinate the application conflicts be-tween the two.The inability of the parties to reach a consensus on the discounted compensation for unregis-tered houses is not a sufficient reason for the decision not to be processed;the object of the discounted compensation is the management and use rights or the ownership of the property,which depends on the court's handling of unregistered property inheritance disputes.
