摘要

生活中存在大量涉第三人房屋权属纠纷,为保护交易安全,立法倾向于保护第三人,不动产善意取得制度的确立即是明证.但反观司法实践,此类纠纷存在"同案不同判"现象,即有的判决体现"第三人中心主义",有的判决体现"原权利人中心主义".随着时间推移,司法保护重心转向"原权利人中心主义",转向的路径是"制度类推+法理"模式的司法续造,原因是法官对原权利人和第三人进行了个案利益平衡,明确了原权利人的"事实物权人"、第三人的"法律物权人"地位,基本遵循"事实物权优先于法律物权受保护"的主旨,即原权利人一般不因瑕疵转让失权,除非第三人完全符合严苛的取得条件,为此,司法续造了"无归责,不失权""'善意'的双重标准""房与证一体化转移""长期占有的强公示效力"等适用逻辑,共同指向"原权利人中心主义"的保护宗旨.

Abstract

In life,there are a large number of disputes involving the third party's house ownership.In order to protect the security of transactions,legislation tends to protect the third party.The system of bona fide acquisition of real estate is indeed immediately proved.However,in judicial practice,such disputes exist the phenomenon of"different judgments in the same case",that is,some judgments reflect the"Third Party Centralism",and some reflect the"Original Right Holder Centralism".With the passage of time,the focus of judicial protection turns to the"Original Right Holder Centralism".The path to turn is the judicial renewal of"system analogy+jurisprudence"model.The reason is that the judge has bal-anced the interests of the original right holder and the third party,clarified the status of the original right holder as the"actual real right holder"and the third party as the"legal real right holder",and basically followed the theme of"the actual real right is protected before the legal real right".That is,the original right holder generally does not lose the right due to defects,unless the third party has strict acquisition conditions.Therefore,judicial continued to create the application logic of"no liability,no loss of right","double standard of'good faith'","integrated transfer of housing and certificate","strong publicity effect of long-term possession",and so on,which jointly pointed to the protection purpose of"Original Right Holder Centralism".
