高昌回鹘的私有地权研究

摘要
吐鲁番所出的回鹘文地权流转契约文书,内容涉及交换、买卖、继承、租佃、典押等,为考察高昌回鹘私有地权的占有形式、流转形式、保护提供了珍贵资料.各类占有形式的地权均有流转,但以单户地权、多户地权为主.流转形式灵活多样,但以买卖、租佃为主.高昌回鹘的私有地权受到了习惯法与"官法"的双重保护.
Abstract
The documents of land circulation unearthed in Turpan,which involve in exchange,sale,inheritance,tenancy and mortgage etc.,provide precious materials for investigating the category,circulation and protection of private land ownership of the Gaochang Uighur.Different kinds of land ownership are all circulated,but mainly in ownership of a single or multiple households.The forms of land circulation are flexible and various,but mainly in saling and tenancy.The private land ownership of Gaochang Uighur is protected by customaries and laws.
