摘要
伴随着数字技术的应用和发展,馆藏资源数字化转型成为我国博物馆馆藏工作发展的必然要求,有助于提高博物馆馆藏资源的管理保护水平和工作效率,而馆藏资源数字化的前提是能否依法依规对博物馆馆藏资源数据进行处理.依据我国现行法律和相关政策规定,本文拟从博物馆馆藏资源数据处理的基本内涵和特点切入,从法律层面对馆藏资源数据的持有权、加工使用权和产品经营权予以探讨,在此基础上提出我国博物馆馆藏资源数据处理的5条具体规则.
Abstract
With the application and development of digital technology in order to improve the performance and efficiency of museum collection conservation,it is inevitable to conduct the digital transformation of the collection.The premise of museum collection digitization is the legitimacy of the data processing.Basing on the current laws and policies in China,this article starts from the basic concepts and characteristics of data processing of museum collection,then discusses the possession,processing,using,and product management rights of the data from the legal perspective,and proposes the specifications of data processing of museum collection in China.
