摘要
2022 年 8 月,根据信访举报,山东省A市农业农村局查处了一起经营违法添加及未备案饲料产品案.本文阐述了该案的案件来源以及调查取证、查明事实、行政处罚等执法过程,从案件事实、证据、程序、适用法律、自由裁量等方面进行了分析,并对相关问题进行了思考与探讨,以期为同类案件的查办提供参考.
Abstract
In August 2022,following a complaint report,a case of operating feed products containing illegal additives or without a license was investigated and punished by the Bureau of Agriculture and Rural Affairs in A City,Shandong Province.In the paper,the source of the case as well as the law enforcement process including investigation and evidence collection,fact-finding,administrative punishment,etc.,were described,the case was analyzed in terms of facts,evidence,procedure,applicable laws and discretion,etc.,and relevant issues were considered and discussed,with a view to providing a reference for future response to similar cases.
