Discussion on the Judicial Identification of Animal Medical Treatment Injuries Based on Disputes from Pet Medical Treatment
Disputes from animal medical treatment injuries have been increasing with the increase of the number of pets in China,requiring an appropriate resolution.Judicial identification could effectively prove the facts of cases,divide responsibilities and clarify causes and consequence,which is conducive to scientific settlement of disputes from animal medical treatment injuries,standardize medical treatment markets,and safeguard legitimate rights and interests of service providers.However,based on the analysis of legislation of judicial identification of animal medical treatment injuries and judicial status,it was found that legislation on judicial identification system of animal medical treatment injuries was missing in China,leading to a dilemma in practice.In order to solve the above problems,the system should be clearly defined by legislation,and supported by expert database,unified identification standards,identification agencies and identification procedures.Here,legal significance of judicial identification of animal medical treatment injuries was discussed based on the disputes from the practice,followed by relevant recommendations,aiming to provide a reference for the development of judicial identification system of animal medical treatment injuries in China.
