The constitutional ethos is becoming a formal concept and a review standard in China's law.There are currently three major understandings,referring respectively to the consciousness of respecting the Constitution,the purpose of the Constitution,and the constitutional ethos as parallel to constitutional provisions and principles.Only the third understanding belongs to the specific and normative constitutional ethos in constitutionality review.The NPC and its Standing Committee as well as its working bodies have mainly used the term in the context of'promotion','compliance','constitutional provisions and constitutional principles',and'being subject to people's supervision'.They have also indirectly dealt with the constitutional ethos in some specific cases,all these contexts and cases provide useful references for ultimately determining the content of the constitutional ethos.In future practices,the application of the constitutional ethos should pay attention to balancing stability and openness,ensuring systemness and sequentiality,and adhering to uniqueness and creating enthusiasm.
