Codifying the education law faces challenges in determining which education-related norms should be included in the education code.Having reviewed all the norms related to'education'within China's legal system,we found that the main points of contention include'education'norms in the sense of legal responsibility,'publicity education'norms,in-service education norms,national education norms,and specific types of educational norms.The main methods for determining whether norms related to'education'should be included in the education code are the Constitution's provisions,principles,and spirit;drawing on the experience of compiling the Civil Code;and the revised paradigm of'industry law'.According to the above methods,the education code should not include the norms of'education'in the sense of legal responsibility.The'publicity education'norms should only be included in the education code if they relate to the education sector.Among in-service education norms,vocational education norms aimed at all industries should be included in the educational code.The national education norms for national defense education,patriotic education,and physical and health education involving the education department and schools should be included in the education code.The education code should include special education norms and norms for protecting minors'education.Norms related to specific types of education,such as those concerning medical and agricultural education,should not be included in the education code.
