In the era of the platform economy,the mode of labor management has developed new characteristics.Its subordination is endowed with new doctrinal connotations and also establishes basic standards for incomplete labor relations.The third batch of typical cases of labor and personnel disputes jointly released by the Ministry of Human Resources and Social Security and the Supreme People's Court provides good materials for constructing a new legal relationship doctrinal system for employment.It can be summarized as the'qualitative review model of industry typification based on subordination weight order'.Under the'subordination+element-based'recognition concept,exploring the manifestations of personality,economic,and organizational subordination in different industries,based on the actual use of labor,excluding the influence of consensus,and following the core judgment elements commonly used in each industry and personalized elements applicable to the industry when considering the three types of subordination.Economic subordination is a key to interpreting incomplete labor relations,which can accurately position the legal relationship of new forms of employment and achieve targeted empowerment of labor rights.
