'How do lawyers think'is a question that the academic circle has always been paying attention to but has not been explained clearly.From the perspective of cognitive science,human thinking is a kind of mind computation.Since the language of the human brain is not mathematical language but statistical language and mainly natural language,mind computation is soft computing that does not pursue accurate solutions and has great flexibility.Especially under the condition of incomplete information,soft computing is the comprehensive application of the Bayesian method and linguistic approach.The essence of the Bayesian method is updating the probability with new evidence,and the probability can be expressed by linguistic probability(fuzzy language value),so the mind computation model can be summarized as:soft computing=Bayes Rule+linguistic probability.In short,human thinking follows Bayes'Rule.We revise constantly the subjective prior understanding of things according to new evidence information,conclude the objective posterior understanding,and then make the final decision.This mind computation model is highly consistent with the thinking process of lawyers,especially the judgment process of judges.
