人类命运共同体理念蕴含独特的国际法理念、价值和原则,它所倡导的人类命运不可分的整体世界观和方法论,为阐释和发展国际法治、指导国际造法和国际司法提供了价值源泉与基础.一方面,它凸显了人类的整体利益和长远利益,为国际法注入了和谐与可持续发展的价值,深化和拓展了国际法原则的内涵和外延,并为国际法引入了可持续发展与共商共建共享的新原则;另一方面,它影响了人类百年未有之大变局下国际社会结构和形式,发展了人类命运共同体理念下国际法理论、价值、原则和规则的内在逻辑,促进了国际法理论创新与范式转型,丰富了中国特色国际法的内涵,有助于提升中国在全球治理规则制定中的话语权.
Abstract
The concept of a community with a shared future for mankind encompasses profound philosophies,values,and principles in international law.Its advocacy for an indivisible holistic worldview and methodology provides a valuable source and foundational theory for interpreting and advancing international rule of law,guiding international lawmaking and international adjudication.On the one hand,it highlights the collective and long-term interests of humanity,infuses international law with the values of harmony and sustainable development,deepens and expands the connotation and extension of international legal principles,and introduces new principles of sustainable development and'extensive consultation,joint contribution,and shared benefits' into international law.On the other hand,it influences the structure and form of the international community amid global changes of a magnitude not seen in a century,develops the internal logic of theories,values,principles,and rules in international law under the framework of a community with a shared future for mankind,promotes theoretical innovation and paradigm shift in international law,enriches the connotation of international law with Chinese characteristics,and enhances China's discourse power in the formulation of global governance rules.
