Medical expert opinions have become key evidences in medical malpractice litigation,but the appraisers providing the medical expert opinions often lack professional ability and are not qualified appraisers,making it difficult to ensure the quality of medical expert opinions,which leads to a deviation in the judgment of medical malpractice litigation cases.There are three main problems in medical expert opinions:the judgment of medical fault is not based on whether the medical personnel have fulfilled the duty of diagnosis and treatment,the judgment of causality is lack of evidence-based evidence,and the evaluation of disability degree is mechanically performed according to the Evaluation Criteria for Degree of Disability.The scientificity of medical expert opinions should be ensured,and peer review is the most basic principle that medical expert opinions should abide by.At the same time,increasing the transparency of the appraisal process and related details of medical expert opinion,and detailing the professional information and appraisal analysis opinions of the appraiser in judgment documents,can strengthen the scientificity of medical expert opinions.
