中国海事高级法院设立的困境与路径

摘要
海事法院作为目前中国具有特色的海事专门审判机构于成立的三十多年来,在海事审判领域发挥了极其重要的作用,是中国面向国际社会的一个亮丽窗口.近年来中国对海洋权益的重视日益加深,先后提出了建设海洋强国战略、"一带一路"倡议、建设国际海事司法中心战略.这些战略的提出和实施都为设立海事高级法院提供了历史机遇.若要抓住此机遇,还需解决现存于理论与实践中的,阻碍海事高级法院成立的几个障碍.另外,设立海事高级法院目前存在不同的路径,如何选择一种合适的方法也值得进行研究.
Abstract
China's maritime courts are well known by the world,as the special jurisdiction of court is peculiar to the nation. The maritime courts were established roughly 30 years ago.Since their establishment,maritime courts have played a key role in maritime trials and demonstrate fairness,impartiality and professional competence to the world.The government puts for-ward the strategies of building China into a marine power and setting up a judicial center for international maritime affairs,as well as the Belt and Road initiative.Implementing the strategies and initiative requires the participation of and support from maritime courts.To establish the maritime high court,finding a way out of dilemma is important.Moreover,there exists dif-ferent paths to establish maritime high court,how to choose the way also should be considered.
