摘要

家庭教育、学校教育和社会教育共同构成了教育生态体系,家庭教育立法是家庭教育法治化的必要保障,也是推动教育现代化建设的重要组成部分.我国家庭教育立法经历初步建设、深化拓展、守正出新三个时期,呈现从工具理性向价值理性转变、从家长教育向家校社协同转变、从笼统模糊向制度化建设迈进的演进逻辑.我国家庭教育立法的未来进路有三条:优化完善地方法规,构建中国特色立法体系;明晰主体职责权限,形成多元协同治理格局;建立监测评价机制,保障立法真正落地落实.

Abstract

Family,school and social education constitute education ecosystem.Family education legislation is the guarantee of its legalization and an important component of promoting education modernization.Family education legislation in China has gone through three periods:preliminary construction,deepening and expansion,and integrity and innovation,presenting the evolution logic of transforming from instrumental to value rationality,from parent education to family,school,social collaboration,and from general ambiguity to institutionalization.In the future,the legislation should optimize and improve local regulation and build a legislative system with Chinese characteristics,clarify the responsibilities and authorities of main body and form a diversified collaborative governance pattern,and establish monitoring and evaluation mechanism to ensure the true implementation of legislation.
