摘要
在数字政府建设中,技术资本的扩张已成为不争的事实,它通过对技术的掌握、信息资源的影响以及对决策的干预等方式入侵数字政府建设,冲击着数字政府建设中政府的公权力.由于数字政府在建设过程中缺乏合理的技术资本审查标准和融贯的技术资本监管机制,资本才得以借由技术入侵数字政府建设,长此以往,可能会造成政府公信力持续下降、政府公共服务性丧失的后果.基于此,为了更好地对技术资本侵蚀进行治理,应当对技术资本进行法律规制,从技术资本审查标准合理化、技术资本监管机制完备化、数字政府建设(公民)参与制度化和数据权利国家保护合法化4个维度规范技术资本的参与方式,以期完善数字政府建设的法治进路.
Abstract
In the construction of the digital government,the expansion of technological capital has become an undeniable fact.It infil-trates the digital government construction through mastery of technology,influence on information resources,and intervention in deci-sion-making,challenging the government's authority in the construction of digital government.Due to the lack of reasonable standards for the review of technological capital and a coherent regulatory mechanism of the technological capital during the construction of the dig-ital government,capital is able to penetrate the digital government construction through technology.Over time,this may result in a con-tinuous decline in government credibility and the loss of government public service capabilities.Based on this,in order to better govern the erosion of technological capital,it is necessary to regulate technological capital through legal means.This should include rationali-zing the standards for technological capital review,perfecting technological capital regulatory mechanisms,institutionalizing(citizen)participation in digital government construction,and legalizing the protection of data rights at the national level.These four di-mensions should be used to regulate the participation of technological capital,aiming to improve the rule of law in the construction of the digital government.
