The Fair Competition Implication and Governance Strategy of Intellectual Property Policy
Intellectual property policies inherently embody the principles and requirements of fair competition at the levels of policy ob-jectives,policy functions and policy effects.Upon conducting an empirical analysis of China's intellectual property policy,it has been found that those characterized by intense administrative intervention and strong preferential biases hold inherent risks to fair competi-tion.Such risks,in turn,hinder the flow of innovative elements,escalate the costs associated with innovation,and diminish its vitali-ty.The fair competition review system plays a crucial role in delineating the boundaries between government and the market as well as regulating government intervention.Incorporating intellectual property policies into fair competition review can help promote the rule of law in policy governance.It is necessary to tailor the value orientation and review standards of fair competition review of intellectual prop-erty policies according to their characteristics,building a"black,white and gray"review list system and exemption system,and form special review guidelines.At the implementation mechanism level,this should be accompanied by enhancing the review motivation of the main bodies conducting fair competition reviews of intellectual property policies,optimizing the coordination review mechanism,as well as strengthening the participation and oversight aspects of the review process.
