生成式人工智能的竞争风险、监管逻辑与反垄断应对

2022 年末,ChatGPT的崛起标志着生成式人工智能迈入新发展阶段.生成式人工智能在推动科技产业创新、赋能数字中国建设的同时,可能会产生双层竞争风险.在市场结构层面,技术与财力将导致高进入壁垒;在限制竞争行为类型层面,生成式人工智能可能涉及限制竞争程度更大的算法共谋、限制竞争的自我优待与拒绝访问,以及大型跨市场并购.据此,我国应明确生成式人工智能竞争风险的监管逻辑,包括重塑监管价值取向与界定技术标准.最后,通过建立新逻辑范式下生成式人工智能的反垄断规制路径,即引入互操作制度与创新补贴政策以实现市场进入壁垒的降低,以及导入生成式人工智能垄断行为的规制方案,共同推进生成式人工智能的竞争风险防范,实现长期创新发展.
Competitive Risk,Regulatory Logic and Anti-Monopoly Response of Artificial Intelligence Generated Content
At the end of 2022,the rise of ChatGPT marked a new stage in the development of artificial intelligence generated con-tent.While generative artificial intelligence promotes innovation in the science and technology industry and enables the construction of digital China,it may create a two-tier competition risk.At the level of market structure,technology and financial resources will lead to high barriers to entry;At the level of types of behavior that restrict competition,generated content AI may involve algorithmic collusion that restricts competition to a greater extent,self-favoring and denial of access that restricts competition,and large cross-market acqui-sitions.Therefore,China should clarify the regulatory logic of artifical intelligence generated content competition risk,including resha-ping the regulatory value orientation and defining technical standards.Finally,by establishing the anti-monopoly regulation path of arti-ficial intelligence generated content under the new logic paradigm,that is,introducing interoperation system and innovation subsidy policy to achieve the reduction of market entry barriers,and introducing regulatory schemes for artificial intelligence generated content monopoly behaviors,we can jointly promote the prevention of competitive risks of artificial intelligence generated content and achieve long-term innovation and development.
