中国式法治现代化的演进历程、鲜明特征及现实启示

摘要
中国式法治现代化产生和发展于党领导人民推进我国法治事业的伟大实践中,是当代中国法治建设的核心命题.中国共产党历来高度重视中国式法治现代化建设,并善于在党的全国代表大会报告文本中进行论述.从党的十二大至二十大报告文本关于中国式法治现代化的论述中可以看出,其演进历程经历了法制建设阶段、由法制向法治转型阶段、深化法治建设阶段和全面依法治国阶段,这其中蕴含了中国式法治现代化的鲜明特征,即鲜明的问题导向性、突出的创新发展性、显著的科学理论性和深邃的历史继承性.纵观其演进历程和鲜明特征,可以得出如下启示:中国式法治现代化建设必须坚持党的领导、坚持马克思主义法治思想、紧扣中国特色社会主义法治实践.这些启示为新时代新征程持续推进中国式法治现代化建设提供了经验参照和实践遵循.
Abstract
The CPC attaches great importance to the modernization of the rule of law in China,and is good at discussing the modernization of the rule of law in China in the reports of the National Congress of the Party.Since the reform and opening up,nine Party congress reports have all discussed the modernization of the Chinese-style rule of law,from which it can be seen that since the reform and opening up,the modernization of the Chinese-style rule of law has undergone the stages of legal system construction,transition to the rule of law,deepening the rule of law construction,and comprehensive rule of law.It has distinctive characteristics such as combining self-confidence and self-improvement with problem awareness,integrating stability and innovation,and integrating science and history.A systematic analysis of the process and characteristics of the modernization of the rule of law in China provides the realistic enlightenment that the modernization of the rule of law in China must adhere to the leadership of the Party,adhere to Marxist thought on the rule of law,and adhere to the practice of socialist rule of law with Chinese characteristics.
