摘要
残疾旅客出行权益与航空安全间存在张力关系,发生的纠纷屡见不鲜.基于实证的考察,在发现残疾航空旅客出行权益与航空承运人拒载权界限不清、我国有关规定对残疾航空旅客的歧视风险、残疾航空旅客权益保障规定缺乏可操作性、侵害残疾航空旅客权益之责任承担不明等问题的基础上,衡量问题蕴含的价值.结合法经济学视角,并引入了直接威胁标准,通过比较研究的方法吸收借鉴其他国家或地区先进经验,从实体和程序进路为保障残疾航空旅客出行权益提供建议.
Abstract
There is a tension between the travel rights of disabled passengers and aviation safety and disputes arise frequently.Based on empirical investigations,it has been found that there are un-clear boundaries between the travel rights of disabled air passengers and the air carrier's right to refuse carriage,risks of discrimination against disabled air passengers in the country's relevant regulations,lack of operability of the protection of the rights and interests of disabled air passengers and the in-fringement of the rights of disabled air passengers.By weighing the values inherent in these issues,incorporating a law-economics perspective,introducing the direct threat standard and drawing on the advanced experiences of other countries or regions through comparative research methods,sugges-tions are provided from both substantive and procedural approaches to protect the travel rights of dis-abled passengers.
