澳门数字政府建设的法治化路径

摘要
数字法治政府建设面临如何进行的路径难题.澳门特别行政区 20 余年间数字政府建设的法治经验可形成三重逻辑:一是有法可依的规则之治是给予数字政府建设正当性依据的基石,二是权利保障的价值选择是数字政府权力运作的边界,三是公开透明的理由之治是数字政府建设的机制保障.未来澳门数字政府建设的法治化期待,体现为深度与广度的拓展以及区域合作的变革.因此,在坚持既有法治路径的基础上,需进一步完善跨域合作制度.这亦为内地数字法治政府建设带来新机遇.
Abstract
The building of law-based digital government is faced with the challenge of development path.Over the past 20 years,the experience of building law-based digital government of the Macao Special Administrative Region can be summarized by a triple logic.Firstly,the rule of law that can be followed is the cornerstone of legitimacy for building digital government.Sec-ondly,the value choice of rights protection is the power operation boundary of digital government.Thirdly,the rule of open and transparency is the mechanism guarantee of building digital government.The rule of law of building future digital government of Macao will be reflected in the expansion of depth and breadth as well as the transformation of regional cooperation.Therefore,on the basis of adherence to existing legal path,it is necessary to further improve cross-regional cooperation system.This also brings new opportunities for building law-based digital government in the mainland.
