Study on the management of patent infringement risk in technological innovation of latecomer enterprises based on ERM-EIPM
Patent infringement risk poses a significant challenge to the technological innovation of latecomer enterprises.This paper proposes a study that addresses this problem through a framework integrating Enterprise Risk Management(ERM)and Enterprise Intellectual Property Management(EIPM).The study adopts a multi-step approach that includes(1)identifying the patent infringement risk factors throughout the technological innovation process,including project initiation,research and development,procurement,production,sales and after-sales activities;(2)examining the relationship between these risk factors,leading to the construction of a related risk probability algorithm model that is factored into the overall probability assessment of spontaneous risk;(3)presenting a response map on managing patent infringement risk while considering related risks based on the determined risk level and total probability;(4)establishing a comprehensive management mechanism for patent infringement risk that involves cross-functional collaborations.This study aims to support the high-quality development of latecomer enterprises,thereby contributing to the construction of a robust intellectual property landscape.
